Austin’s Paid sick leave in the hands of Texas Courts

The eyes of Austin restaurants are on the Texas Courts after the State legislature’s effort to roll back Austin’s Paid sick leave ordinance fell through.

Texas Restaurant Association CEO Richie Jackson says the Texas 3rd Court of Appeals’ has put a hold on the controversial ordinance which is staving off its implementation for now. He explained, “the City of Austin has appealed the third court’s decision to the Supreme Court of Texas. But they have requested postponements…twice. So the Supreme Court at some point I think will have to consider whether they’re going to take up that case or not.”

Jackson said if the Texas Supreme Court does take up the case, their decision could also impact other cities who implemented similar rules.

Texas Lawmaker’s argument over the bill turned into a controversial debate about non-discrimination ordinances, Jackson continued, judges are preempting the ordinance due to existing minimum wage laws.
