The State of Texas makes its case that the Affordable Care Act is now unconstitutional. In a court hearing, the Attorney General’s office argued that the only thing that made the ACA constitutional was the penalty for not having health insurance, that was done away with.
But the tax cut law does away with that penalty, and with no penalty it’s not constitutional.
There was no immediate ruling by the judge.
