A Travis County judge says there wont be a ruling on a case where petitioners and the City of Austin argue over a possible public say on the land use rules rewrite, CodeNEXT. Council members have cited legal experts saying residents can’t vote on the rewrite because its a zoning ordinance. Petitioners’ lawyer Fred Lewis said that city lawyers continue to say, since the land use rules rewrite is a zoning ordinance, the people, despite a successful petition, do not have the right to vote on it.
IF he wins, Lewis hopes Austinites will get to say on the November Ballot whether or not they want to vote on CodeNEXT.
