- Gov. Greg Abbott, Lt. Gov. Dan Patrick, House Speaker Dennis Bonnen and Texas Attorney General Ken Paxton are reminded Texas district and county attorneys in a letter that the new law legalizing hemp does not decriminalize marijuana
- The letter stated, “failing to enforce marijuana laws cannot be blamed on legislation that did not decriminalize marijuana in Texas”
- The new law, House Bill 1325, which legalized hemp and hemp-derived products like CBD oil, was signed into law on June 10th
- Many district attorneys since the signing of the law say they cannot pursue charges for misdemeanor marijuana cases due to the lack of testing abilities as they cannot legally distinguish between legal hemp and marijuana
- The new law changed the definition of marijuana as a cannabis plant that contains more than 0.3{2db634631ef8bd3f096060bc7daa4fc6677d16e616113d8c02bec6b420e3105c} of tetrahydrocannabinol, the psychoactive ingredient in marijuana that produces a high
- Anything less than that would be considered hemp
